Important Note on Case Review Eligibility (Please Read Carefully):
Claims We Can Review and Possibly Take:
Due to high contact volume and current caseload, we have unfortunately had to limit our initial case review to potential claims involving only the following:
- New Vehicle Lemon Law Claims – these involve vehicles, motorcycles, RVs, or Campers bought new and that are still within the warranty period (for most cases, this is the five years before the current year)
- Used Vehicle Warranty Claims – these involve used vehicles purchased with an existing dealer warranty, service contract, or with a remaining manufacturer warranty. For such claims, we will only review claims for vehicles newer than ten model years.
- Auto Fraud – We only will review auto dealer fraud claims involving undisclosed accident damage, lemon law buyback history, flood damage, and salvage title for vehicles that are ten years old or newer.
Claims We Cannot Review or Take:
- Commercial Vehicles – cases involving semi trucks, dump trucks, cargo trucks, etc.
- Used Vehicle Defect Claims: As-Is Vehicles – cases involving used vehicles purchased without a dealer warranty, service contract, or existing manufacturer warranty (i.e. As-Is No Warranty, or without any existing manufacturer warranty).
- Warranty Claims for Anything Other than a Car, Truck, Motorcycle, RV, or Camper – we do not review or take cases involving warranty claims for items such as HVAC systems, water coolers, solar panels, etc. Other attorneys may have different policies regarding such cases and we recommend contacting others who may be able to assist.
- Negligent Repair – we cannot review cases for vehicles damaged by the negligence of a repair shop, oil change facility, or mechanic (See Below for Further Assistance). Other attorneys may have different policies regarding such cases and we recommend contacting others who may be able to assist.
- Dealer Failure to Provide Title or Registration – in general, except in certain circumstances, we do not get involved in cases involving a dealer’s failure to provide title or registration. Such matters can often be corrected by filing a complaint with the North Carolina Division of Motor Vehicles License and Theft Bureau. If you still do not get the title or registration issue resolved after your complaint is investigated or you are directed to contact an attorney by the License and Theft Officer investigating your case, please contact us.
- Spot Delivery (Yo-Yo Transactions) – Unfortunately, due to changes in case law on this issue, we no longer review or handle cases involving spot delivery transactions unless the selling dealership refuses to return the buyer’s downpayment or trade in vehicle. In most cases, if a dealership contacts you about returning your vehicle due to an alleged problem with financing being finalized, we cannot get involved in such matters or review the cases unless you do not get a full refund of your downpayment after returning the vehicle or the dealer refuses or is unable to return a trade in vehicle. Please contact us if that if is the case and we can review your options. Other attorneys may have different policies regarding such cases and we recommend contacting others who may be able to assist.
- Claims Against Dealers from Outside North Carolina – If you live in North Carolina and purchased a pre-owned vehicle from a dealer in another state, we cannot help you in claims against the dealer. You will have to contact a consumer lawyer in the state where the dealer is located. Please visit the National Association of Consumer Advocates to find an attorney in the selling dealer’s state.
- Non-Auto Related Consumer Claims – we do not handle cases involving debt collection, credit reporting, solar panels, time shares, mortgage or real property sales.
- Criminal Defense – we do not handle criminal defense matters.
